What is a proposal for entry into the Land Register
In the case of buying or selling a property, signing the purchase contract is not the last step. For the actual ownership of the property, the ownership right must be registered in the Land Registry on the title deed (LV), which can be achieved by filing a petition for entry in the Land Registry. This application is usually filed by the buyer, but can be filed by any of the parties.
How much is paid for a proposal for entry into the Land Register
Filing a petition for entry into the Land Register is not free of charge and a fee of CZK 2,000 is payable, as specified in the Administrative Fees Act (No. 634/2004 Coll.). The fee can be paid by bank transfer, card payment or cash at the relevant cadastral office.
You need to file a petition for entry into the cadastre
It is necessary to attach the relevant document (purchase contract, donation contract, inheritance decision, etc.) to the application for registration. The document must be either an original with certified signatures or a certified copy with certified signatures.
How to fill in the application for deposit
- The form for filing a petition for entry into the Land Registry can be obtained either on paper, either at the Land Registry Office, or you can print it yourself.
- It is also possible to download the form from the website of the Cadastral Office and fill it in on the computer.
- The last option is to use an interactive form available on the internet that offers different scenarios for situations where a proposal will be filed.
An easy way to submit a deposit application is to use the web application, which allows you to fill in a new application or continue an ongoing application. When submitting a new application, you must first select the way in which you acquired the property (e.g. purchase, gift, exchange, etc.). You must then fill in the details of the property (type, cadastral area, parcel number) and the details of the parties (seller and buyer) and their legal representatives, if any. The original owner of the property is always pre-filled in the interactive form. You must also attach attachments, such as the number of the purchase contract or the geometric plan, and identify the competent cadastral office.
How to apply for a deposit
In order to successfully complete the application for registration, the completed and signed form together with the relevant attachments must be delivered to the relevant cadastral office. Delivery may be made in person or by post (preferably by registered mail). If you choose to submit the form by post, you must affix a stamp worth CZK 2,000, which can be purchased at the post office and affixed in the upper right corner of the form. If all the documents are correctly filled in and delivered, the registration in the Land Registry / deletion from the Land Registry is usually made within 30 days. The progress of the procedure can be monitored in the Land Registry.
